New Jersey DWI-DUI Attorney

Successfully Defending DWI-DUI Charges for Over 25 Years

If you were arrested for Driving Under the Influence in violation of N.J.S. 39:4-50, you should speak to an attorney immediately about your options.

At Lenahan & Rockwell, our experienced Municipal Court attorneys know New Jersey's drunk driving law and will throughly investigate the charges against you to determine if the police had a lawful basis to stop your vehicle and administer any field sobriety tests as well as any tests used to ascertain the amount of alcohol or drugs in your system.

If your blood alcohol reading (BAC) is .08 or above, you are technically guilty of a driving under the influence even if you do not exhibit any signs of intoxication. This is called a per se violation of New Jersey's drunk driving statute.  You need an attorney familiar with New Jersey's drunk driving law to analyze the evidence against you and determine if your BAC reading can be challenged in Court.

Pleading Guilty to a DWI-DUI Charge

You should never  plead guilty to a driving while intoxicated charge without first consulting an attorney.  A DWI charge for alcohol or drugs, including prescription drugs,  is a serious offense.

A guilty plea  means significant fines and a mandatory loss of license up to 12 months on a first offense .  Once your license is suspended, you cannot drive for any reason during the period of suspension.    This includes travel to and from work, use of your vehicle in an emergency, to receive medical care or even go to the grocery store.  There are no conditional or provisional licenses in New Jersey.

Additionally, a DUI-DWI is a motor vehicle offense which can never be expunged.  It will remain on your driving record permanently which can impact future employment opportunities and will likely raise your car insurance premiums.
